SOROTI: Joan Nyapendi, a widow in Soroti city has been evicted from her marital home for remarrying and bringing new husband to the house.
Nyapendi lost her husband Stephen Omuron in 2009. She later fell in love with a man, whom she brought to the house.
The brothers of the deceased led by Johnson Akileng asked the woman to join her new new husband but she reportedly refused to abide by the demands of the in-laws.
The in-laws went to court and successfully secured orders to evict Nyapendi.
The warrant to give vacant possession of the house to Johnson Akileng was issued in December 2022 but there were some delays due to the presidential directives to stop evictions and amendments of the of eviction laws among other clearance processes.
“What happens is that when the matter has been concluded in court and if the parties don’t comply with the services of court, then the services of the court bailiff are sought for,” Emadu Thomson, the managing partner Soroti Associate court bailiff and general Auctioneers, narrated.
Adding: “In this particularly case, the judgement debtor was given 90 days notification to either contend or reverse the eviction but she did not in any way dispute to the eviction notice hence eviction had to be enforced.”
He says that court case under civil suit number 36/2018 determined that the house belongs to
Johnson Akileng and therefore he waned to re-possess his house.
The LC1 of cell “K” Job Isaac Ilaborot Ocodio, one of those witnessing the eviction, said the exercise was peaceful.
Meanwhile, Josephine Ibaseret the deputy Resident City commissioner Soroti City west Division says the case was also handled on 9th march 2023 but Nyapendi adamantly refused to leave the house.
She however advised the members of the public to co-exist and settle disputes amicably while following the law.
