The Soroti Golf Club Registered trustees are in trouble as Soroti High court has finalized plans to attach their property arising from the case they lost to the defendants, Soroti Golf Club Ltd. The Court has given the registered trustees upto 21st August to show cause why they shouldn’t pay the costs.
The background to the case arose when the registered trustees of soroti golf club ltd ran to court in 2017 to challenge the decision of Soroti District Land Board to award Soroti Gold Club Ltd a new lease of 49 years in 2009. The trustees in their case argued that they were the Bonafide occupants of the land and that they should have been given priority before the new applicant was considered. On the contrary the defendants argued that the Lease title for the registered trustees had expired by around 2001 and that for close to eight years they had not shown cause to renew it thus the land reverted to the leasing authority and that such authority had the right to lease it to any other interested applicant.
According to Soroti Golf Club Ltd ,they followed all the required legal processes to apply for the land from Soroti District Land Board. Court contended that (Soroti Golf Club Ltd) like any other interested applicant had the right to apply for the said land whose lease had expired. Court also argued that the registered trustees at the time had enough time to apply for renewal of lease if they so wished and that stopping any other interested person from applying for the said land eight years later when the land was available does not make any legal sense.
Sometime in 2017 the said registered trustees of soroti club filed civil suit no 137 of 2017 against soroti golf club Ltd which suit was dismissed with costs of ug shs 137.155.000 that soroti golf club is pursuing payment thereof agnaist the trustees and the application why they should show cause why they should not be committed to prison is fixed for hearing on 21st August 2023 at soroti high court.(see copy of notice attached).
Further sometime back in 2022 the same registered trustees of soroti club filed a fresh suit where they are purporting to be equitable owners of the tiltes registered in the names of soroti golf club and they sought to get a temporary injunction against soroti golf club but the same was dismissed with costs which they are yet to pay to soroti golf club ltd.
